Tripibuss rental agreement (general terms)

1. Definitions
Lessor - Tripibuss OÜ. Renter - a natural person or legal entity entering into the agreement. Agreement - the vehicle rental agreement together with booking confirmation, order details, and terms for additional services. Period - the period during which the Renter may use the Vehicle. Vehicle - the rented minibus or other vehicle with documents, keys, and agreed accessories. Additional services - for example cleaning, refueling, delivery/collection, extra coverage, etc. (if listed in the order).
2. Booking, payment, and cancellation
2.1. The Agreement is considered concluded when the Lessor confirms the order/booking and the Renter pays the rental fee (or other agreed payment) through Tripibuss.ee or by invoice. By paying, the Renter confirms they have reviewed and accepted the rental terms.
2.2. Payment methods: bank transfer and, by agreement, on-site cash or card payment. Settlement currency: EUR.
2.2.1. Maksevahendajad: Montonio Finance OÜ, SumUp EU Payments UAB.
2.3. Booking fee / advance payment:
- If the rental period starts more than 30 days from booking, the Lessor may request an advance payment of 30% of the total amount to confirm the booking.
- The remaining amount is paid as stated in the booking confirmation (for example before rental start by invoice or online payment).
2.4. Cancellation (when advance payment is paid):
- If the Renter cancels more than 14 days before rental start, the advance payment is refunded.
- If the Renter cancels 14 days or less before rental start, the advance payment is not refunded.
2.5. If the rented vehicle is returned early, the paid rental fee is not refunded.
3. Rental period and minimum rental term
3.1. The default minimum rental period is 48 hours (48 h / 2 days). 3.2. Rental start and end are specified in the booking confirmation.
4. Required documents and drivers
4.1. The Renter must provide a valid identity document and valid driver's license for contract execution.
4.2. The Vehicle may be driven only by persons listed in the Agreement:
- the primary driver, and
- if needed, up to 2 additional drivers (for longer trips), if listed in the Agreement.
4.3. The Renter may not transfer driving rights to a third party without prior written approval from the Lessor.
5. Vehicle handover and return
5.1. Unless vehicle delivery/collection or another handover method is ordered, the default handover and return location is the Lessor's address (Tähe 18, Tartu).
5.2. The Lessor may refuse handover if the person collecting the Vehicle cannot be identified or lacks authority to act on behalf of the Renter.
5.3. The Renter must return the Vehicle at the agreed location and time at rental period end. Abandoning the Vehicle is prohibited.
6. Area of use and travel abroad
6.1. The Vehicle may be used in Europe without a separate permit, but travel is prohibited to:
- conflict or war zones,
- countries/regions where the Republic of Estonia advises against travel.
6.2. For trips outside Estonia, the Renter must select an abroad trip in booking and provide an estimated distance, because the abroad pricing includes up to 1500 km.
6.3. Note: mileage calculation always starts from the rental origin at Tähe 18, Tartu.
7. Mileage and extra kilometers
7.1. There is no mileage limit within Estonia.
7.2. Abroad trips: the price includes up to 1500 km (see p 10.2-10.3). Beyond that, extra mileage fees apply according to the price list.
7.3. Extra mileage packages (abroad) - according to the price list:
- 1501-3500 km: 124 EUR
- 3501-5000 km: 186 EUR
- 5000+ km: 248 EUR
8. Use, prohibitions, and obligations
8.1. The Renter must:
- use the Vehicle carefully and for intended purposes in accordance with instructions,
- take all reasonable steps to prevent damage, theft, or loss.
8.2. Before each trip, the Renter must verify roadworthiness, monitor technical condition while driving, and follow all applicable legal requirements, including traffic rules. In case of technical failure, driving must stop until the issue is resolved.
8.3. Prohibited uses include illegal activity, off-road driving, towing, driving school use, motorsport, racing, etc.
8.4. The Renter must care for the Vehicle diligently and correct defects at own cost under applicable law.
9. Breakdowns, repairs, and costs
9.1. If a breakdown prevents further use, the Renter must coordinate the repair location with the Lessor. Unapproved repair costs are not reimbursable. If breakdown is caused by improper use, the Lessor is not obliged to compensate related expenses.
9.2. The Lessor determines repair location, terms, and scope regardless of vehicle location.
9.3. If a breakdown occurs during rental and is not caused intentionally or negligently by the Renter, the Renter may request up to a 10% discount for the agreed rental period if no replacement vehicle is available.
10. Vehicle condition, cleanliness, and fuel
10.1. The Renter returns the Vehicle clean and with the same equipment completeness as at handover.
10.2. If the Vehicle is returned unclean, inside/outside cleaning fee applies according to the price list (62 EUR). If chemical cleaning is needed, chemical cleaning fee applies (186 EUR) according to the price list.
10.3. Smoking and alcohol use in the Vehicle are prohibited, and violation incurs a penalty of 124 EUR.
10.4. The Renter returns the Vehicle with at least the same fuel level as at handover, unless refueling is ordered as an additional service.
10.5. If the Vehicle is not returned with a full fuel tank, the Lessor may charge for missing fuel by actual fuel purchase price.
11. Accidents, damage events, theft, and documents
11.1. The Renter must immediately notify the Lessor about any damage, malfunction, partial/full loss of functions, destruction, loss, or theft and take measures at own cost to prevent further damage.
11.2. In case of damage to the Lessor or third parties, or loss of documents/items, the Renter and authorized user must submit a written explanation to the Lessor within 24 hours.
11.3. In a traffic accident, applicable legal traffic procedures must be followed.
11.4. In a traffic accident, police must be called to document the event, or the official accident form must be completed. Failure to provide this documentation may result in full liability for damages to the Lessor.
11.5. In case of loss of possession, the Renter must immediately return registration certificate and keys to the Lessor.
12. Liability and insurance
12.1. The Renter bears unconditional responsibility for preservation of the Vehicle from handover.
12.2. KASKO deductible:
- In Estonia: 500 EUR
- Outside Estonia: 1000 EUR
12.3. The Renter must compensate all loss caused by breach of contract to the extent not covered by insurer.
12.4. If insurer compensates loss for which the Renter is liable, the Renter's compensation obligation is reduced accordingly.
12.5. During the Agreement validity, the Renter bears risk of accidental destruction or damage and must cover losses not compensated by insurance.
12.6. The Renter must compensate lost, broken, or damaged parts not covered by insurance.
12.7. The Renter pays repair costs for one punctured tire in the amount of 30 EUR or, if the tire is irreparable, the cost of two new tires.
12.8. If damage is caused intentionally by act or omission of the Renter or authorized user, the Renter bears full liability.
12.9. The Renter bears full loss if the Vehicle is driven under alcohol/drug influence or in a condition unsafe for driving.
12.10. If the Renter transfers the Vehicle to a third party, the Renter bears full liability for damages to the Lessor or third parties.
12.11. If the Vehicle is stolen/unlawfully taken/robbed, the Renter's liability is 15% of full vehicle value plus two months' rental fee if documents and keys are returned.
12.12. If the returned Vehicle requires repair (including chemical cleaning, etc.), the Renter covers additional repair/maintenance costs.
12.13. Damage caused by poor-quality fuel is borne by the Renter.
13. Penalties, default interest, and other fees
13.1. For unreturned documents/keys or incomplete equipment, the Renter pays contractual penalty of 200 EUR per missing item.
13.2. In case of Vehicle abandonment, the Renter pays contractual penalty equal to vehicle acquisition value.
13.3. If the Renter causes an accident increasing the Lessor's insurance risk coefficient, the Renter pays one-time contractual penalty of 100 EUR.
13.4. The Renter is responsible for fines received during rental period. If unpaid, the Lessor may charge collection costs and service fee of 50 EUR.
13.5. Failure to notify the Lessor about a damage event can result in double rental fee penalty plus compensation of resulting damages.
13.6. If rental period is exceeded without Lessor's consent, the Lessor may charge 2x rental fee per exceeded day, and the Renter remains liable for economic damages caused by delay.
13.7. If any monetary obligation is unpaid by due date, the Lessor may charge default interest 0.0278% per day.
13.8. Any monetary claims under this Agreement must be fulfilled within ten (10) days from receiving the claim, unless a shorter deadline is stated in the booking confirmation or damage claim.
14. Lessor rights
14.1. The Lessor may refuse rental, terminate the Agreement, and demand immediate return of the Vehicle if the Renter or authorized user raises justified suspicion, breaches terms, is unable to operate the Vehicle safely, provided false information, or otherwise endangers the Vehicle or Lessor's interests.
15. Personal data
15.1. The data controller is Tripibuss OÜ. Authorized processors for payment processing are active payment partners (see p 6.2.1).
16. Disputes
16.1. All disputes arising from this Agreement are settled by negotiations; if unresolved, in Tartu County Court.
17. Termination
17.1. The Agreement ends at rental period end, on vehicle return (for open-ended cases), by mutual agreement, or on other legal/contractual grounds.
